Did Harvey Ball create Smiley®?
No. Harvey Ball designed a corporate morale badge for the State Mutual Life Assurance Company of America in 1963. He did not trademark, copyright, or develop it further. The Smiley® brand was created eight years later by Franklin Loufrani in 1971 as a trademark, visual identity, and licensing business. These are fundamentally different things.
Did Harvey Ball trademark the Smiley® face?
No. Harvey Ball never trademarked or copyrighted the happy face badge because he had no right to do so.
