SMILEY Launches Prize Draw
Terms & Conditions

By taking part in this prize draw, you agree to be bound by these terms and conditions. If you do not agree with any of these terms and conditions, then you should not take part in this prize draw.
1. THE PRIZE DRAW
1.1. The promoter is Smiley of Lafone House
4.1, The Leathermarket , 11/13 Weston Street Bermondsey , LONDON SE1 3ER (“we”, “us”, “our”).
1.2. The prize draw is free to enter, and no purchase is necessary.
1.3. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.
1.4. This prize draw is in no way sponsored, endorsed, administered by or associated with Instagram and by participating in this prize draw you agree to a complete release of Instagram from any claims arising out of or in connection with this prize draw.
2. HOW TO ENTER
2.1. On 10 November 2023 we will announce the prize draw via the Instagram accounts: @Smiley and @mrmarcomark (the “Post”).
2.2. To enter the prize draw you must (i) follow @Smiley and @mrmarcomark(ii) tag a friend in the comments section of the Post, between 15:00 (GMT) Wednesday 01 November 2023 (“opening
date”) and 11:59 (GMT) Friday 10 November 2023 (“closing date”).
2.3. Entries that are late, lost, delayed, misdirected, incomplete or cannot be delivered or entered for a technical or other reason will not be accepted.
2.4. Your entry must stay live on your Instagram account for the duration of the prize draw.
2.5. No purchase is necessary to enter to win.
3. ELIGIBILITY
3.1. Entrants must be aged 18 years or over to participate in the prize draw.
3.2. We reserve the right to ask any winner to provide proof of age. If the winner does not provide proper identification or age proof, Smiley reserves the right to disqualify such individuals and choose another winner.
3.3. Smiley’s employees (and their immediate family) and those of our group companies, or anyone directly associated with us or the administration of the prize draw, are not eligible to enter the prize draw.
3.4. Entrants must have a valid email address and a valid Instagram account to participate in the prize draw.
3.5. Entrants must reside within countries eligible to receive deliveries from us – if you reside within a country in which we cannot deliver, you are ineligible to participate in the prize draw. You can find this information here.
3.6. In entering the prize draw, you agree and hereby confirm that: i) your entry is original, has not been copied and/or does not otherwise infringe the intellectual property or other rights of any third party, and (ii) your entry does not cause, or is unlikely (in our reasonable opinion) to cause distress and/ or offence to any person, group of people and/or the public.
3.7. By entering this competition, you agree that Smiley may use your name and likeness for its social media promotion while announcing the winner of the competition.
3.8 By entering this competition, you agree that all submissions for the competition shall become the intellectual property of Smiley. If there is any intellectual property that does not automatically assign through this agreement, you agree to execute any documents required to assign Smiley a perpetual, royalty-free, exclusive assignment for your submissions.
3.9 In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win.
4. PRIZE
4.1. There will be one (1) winner who a pair of Smiley x Dr Martens 1460 boots. Prize(s) is/are non-transferable. No substitutions or cash redemptions.
4.2. The winner agrees to at least 30 days for delivery of the prize.
4.3. The prize disbursement is subject to winner confirmation (i.e. we can contact the winner and can confirm eligibility). The winner must also provide us with their full name, a valid postal address and a valid email address in order to claim the prize.
4.4. The prize is personal to the winner and can’t be gifted, transferred or sold and no cash alternative is offered.
4.5. We reserve the right to replace
the prize with an alternative prize of equal or higher value if circumstances beyond our control make it necessary to do so.
5. HOW IS A WINNER SELECTED?
5.1. A winner will be selected by a random draw performed by a computer process.
5.2. Our decision regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
5.3. The winner will be notified via direct message to their social media account shortly following the closing date.
5.4. We will make all reasonable efforts to contact the winner. If the winner does not respond to the direct message within 30 days of being notified by us, then they will forfeit their prize and we may offer the prize to the next eligible entrant.
5.5. We must either publish or make available information that indicates that a valid award took place. To comply with this obligation, we will send the surname and country of residence of the winner to anyone who emails a request to digital@smiley.com within 1 month after the closing date.
5.6. If you have an objection to any or all of your surname and country of residence being published or made available, please email us at Digital@smiley.com In such circumstances, we must still provide the information to the relevant authority on request.
7. LIMITATION OF LIABILITY
Insofar as is permitted by law, we, our affiliates, agents, distributors, representatives and/or employees will not in any circumstances be responsible or liable to compensate any winner or accept liability for any loss, damage, personal injury or death occurring as a result of taking part in this prize draw and/or taking up the prize except where it is caused by our negligence or the negligence of our affiliates, agents,
distributors, representatives and/or that of our employees. Your statutory rights are not affected.
8. GOVERNING LAW & JURISDICTION
8.1. These terms and conditions will be governed by the laws of England and Wales.
8.2. We and you each agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
